SAILING CLUB TERMS & CONDITIONS
Upon joining SEAFORTH SAILING CLUB, member must demonstrate sailing skills for each vessel in the fleet prior to renting said vessel. New members will be required to take a basic sailing class if their sailing experience would be considered insufficient by Seaforth and ASA standards.

MEMBERSHIP TERM: Membership has a minimum term of 12 months. After completing 12 months of membership, member may cancel this agreement with 30 day written notice at anytime. After the first year, if a member wishes to cancel their membership and then rejoin at a later date, he/she may rejoin for $99 subscription fee (and pay any outstanding dues if applicable). SEAFORTH SAILING CLUB reserves the right to cancel any membership by sending 30 day written notice to member. Early termination of Membership may only be completed upon payment of remaining terms or periods in first year.

DUES: Monthly (quarterly, or annual) dues will be paid automatically every month (quarter, or year) by subscribing to a monthly (quarterly, or annual) payment agreement by credit card. Members receive one month free if they prepay one full year (12 months for the price of 11). Monthly (or quarterly) dues may be applied toward boat rentals for said month (or quarter) but are not applicable to merchandise or other purchases. Unused dues cannot be carried over to the next period. Dues are not transferable and member may only apply his or her dues toward his or her own rental on a single piece of rental equipment at a time. Dues may not be combined or split between members toward a single piece of rental equipment.

HULL INSURANCE: All sailboats from 18′ to 35′ have Hull Insurance in the event of an accident, with a deductible of $5000 or 2% of the vessel value (whichever is higher). Members are responsible for the deductible unless they purchase a deductible waiver for $150 per calendar year beginning June 1st. Members who choose to purchase the waiver will only be responsible for up to $250 of the damages. The hull insurance and damage waiver do not cover gross negligence such as driving under the influence, operating the engine continuously at high temperature, sailing in severe weather conditions, sail races, ripped sail, etc, nor does it cover lost items such as anchor, winch handle, fenders, safety kit, etc. Vessels over 25′ in length are under the Vessel Assist towing assistance program while in the ocean, on overnight trips or after business hours and can be reached on VHF channel 16; for any other assistance, call the appropriate location on channel 07. Charges may apply when assistance is provided. Member understands and agrees that any damages, rescue or assistance fees, fines and unpaid dues or rental fees will be charged to the credit card on file given by the member. It is the member responsibility to update Seaforth with any changes pertinent to their credit card number, expiration date, billing address or any necessary financial information. Member agrees that SEAFORTH SAILING CLUB may, at its sole discretion, change, remove, or add boats to the fleet without any liability to the members. All prices posted are subject to change at any time. Boats are available during normal operation at Seaforth Mission Bay, Coronado, and Downtown Boat Rental. Hours are posted on the website and change seasonally.

RESERVATIONS: Reservations may be made up to one year prior to start date. Reservations must be cancelled 7 or more days prior to reservation date for full refund. Reservations will be held for one half hour after reservation start time for late arrivals, after which member will be responsible for 100% of the rental rate, unless equipment is able to be re-rented. Reservations shall only be confirmed upon payment of a small deposit amount by credit card, in the amount of roughly one-half the total rental rate. SEAFORTH BOAT RENTALS offers boat rentals to the public at non-member rates. Member understands that boats are not reserved for the sole use of members, and during peak times some boats may not be available. Club members get special rates for sailboat rentals that can be up to 50% off the public rates depending on vessel. Powerboats up to 20 ft are 25% off for Member and Co-Member. Pedal boats, stand up paddle boards and kayaks are 50% off the public rates everyday for Members. Note that Member discount applies to only one vessel or rental at a time per membership. Seaforth reserves the right to increase the rental rates without notice and for major Holidays. Club rates are posted on the website and at each specific location, these rates cannot be combined with any special offers, coupons or any other promotions. The 8-hour rate is extended to 23 hours for club members on sailboats 27′ and larger and goes from 10:00am through 9:00am the following day. Additional charges may apply for linens, propane, holding tank pump out, etc.

ALCOHOL POLICY: Member will not allow boats to be operated at any time by anyone under the influence of drugs or alcohol. Member will not allow any illegal drugs to be on board boats at any time. Hard alcohol and red wine are strictly prohibited on board all boats and equipment. Glass bottles and containers are strictly prohibited on board all vessels. Member shall operate the boat in a safe and prudent manner at all times. Member is responsible for boat while docked anywhere other than the Mission Bay, Coronado, or Downtown locations. Member shall be responsible for any and all damage done to boat while in their possession including theft of any kind. Please no black soled or marking shoes on board vessels. Member is responsible for checking weather conditions, tides, and currents prior to rental. SEAFORTH SAILING CLUB is not responsible for notifying members of weather

SEAFORTH SAILING CLUB is not responsible for notifying members of weather and / or sea conditions. Any assistance needed, such as towing, given to member due to inclement weather, including excessive or a complete lack of wind, is the sole responsibility of the member and may be subject to additional fees. Member must inspect boat and safety equipment prior to leaving dock and request any equipment that might be necessary (such as winch handle, ocean safety kit, charts, etc.). By taking the boat, member acknowledges that the boat is safe and seaworthy and properly equipped. Upon return, member should notify the dock crew and office of any problem that occurred during the rental. When joining the SEAFORTH SAILING CLUB, member may receive, upon request, a copy of the California boating laws pamphlet. Coast Guard, State, and local laws must be observed at all times including, but not limited to, the maximum number of passengers allowed on board. Member agrees that the boats will remain in the protected waters of Mission Bay or San Diego Bay and may not be taken into the open ocean, except those boats that are specifically designated by SEAFORTH SAILING CLUB as ocean going and only if the member has the level of experience or certification required to do so. Bay-to-Bay trips are allowed on sailboats 25′ and larger and on powerboats 18′ and larger, weather and conditions permitting. Member must have prior ocean going experience on respective boat. Member must be aware of Rule 9 (main channel right of way) that starts from the outside of Buoy 5 when entering the San Diego Harbor channel. When sailing in the Pacific Ocean, member must sail at least 1 mile from the shoreline. Member must be aware of kelp areas and the proper procedures in case kelp gets entangled on the engine or the keel, overheating of an engine, and any other sea wary procedures. Members can take sailboats 27′ and larger for multiple days as long as the boat is equipped sufficiently and only if the member has the appropriate level of experience or certification to do so. On extended mileage trips, fuel will be additional. Fuel tank must be re-filled to the same gauge level at which it was received, or a fee of $6.00/ gallon will be charged for consumption. Holding tank must be emptied prior to return to avoid a $25 charge. Any fuel receipts must be kept for verification by location manager. Limit 2 free kayaks are available to use as dinghies on extended overnight trips. Improper usage of or clogging head will result in a $150 repair fee. Please train your guest(s) on how to properly use the head. When vessel is under sail, engine should be shut down and put in gear to avoid excess wear on the prop shaft cutlass bearing. Fenders must be lowered when docking. This is not a complete list of boating rules. Please ask for further information at the location from which you are renting. It is agreed and understood that if any term, covenant, or provision, of the contract shall be held by a court as invalid, void, or unenforceable, the remainder of this agreement shall remain in full force and effect and in no way be affected, impaired, or invalidated thereby. The “Hold Harmless” clause as well as the general release of liability and other released in the basic “Boat Rental Contract” shall pertain to club members as well as all other items in the rental contract. This document is an integral part of the signed membership agreement and can be modify at any time without notice. The laws of the state of California govern this agreement.
